The Indian Parliament has recently passed the Maritime Anti Piracy Bill 2022, aimed at empowering Indian authorities to combat piracy occurring on the high seas, specifically beyond the Exclusive Economic Zone (EEZ) of 200 nautical miles from India’s coastline. The legislation received approval from both the Lok Sabha and Rajya Sabha, marking a significant step towards enhancing maritime security.
The Bill explicitly defines piracy as any illegal act of violence, detention, or destruction against a ship, aircraft, or individual, intended for private ends and perpetrated by the crew or passengers of a private vessel. In his discussion of the Bill, External Affairs Minister Dr. S. Jaishankar emphasized its importance in solidifying India’s position as a collaborative partner in global initiatives aimed at reducing piracy. He cited historical data indicating that between 2008 and 2011, 27 incidents of maritime piracy involving 288 Indian nationals were reported. In contrast, from 2014 to 2022, the number of incidents fell to 19, with 155 Indian crew members involved, demonstrating the effectiveness of international cooperation in combating this issue.
Dr. Jaishankar highlighted that the Bill provides a robust legal framework to address piracy not only within India’s territorial waters but also on the high seas, which is crucial given that over 90% of global trade occurs via maritime routes. By enhancing India’s ability to take action against piracy, the legislation aims to bolster its credentials on the global stage and improve maritime security.
Participants in the parliamentary discussion expressed their support for the Bill. Dr. Sasmit Patra of the Biju Janata Dal (BJD) commended the legislation, noting that India lacked specific domestic laws addressing maritime piracy until now. Jawhar Sircar from the Trinamool Congress (TMC) remarked on the escalating levels of piracy, calling the introduction of the Bill timely. Prakash Javadekar, representing the Bharatiya Janata Party (BJP), echoed these sentiments, stressing the critical need for legal measures to safeguard maritime trade.
The Bill’s passage underscores India’s commitment to enhancing maritime security and reflects its proactive approach in addressing the growing challenges posed by piracy, ultimately aiming to foster a safer maritime environment for international trade.
